Fees and charges

There are costs associated with the issue and administration of an alpine lease. These may include legal costs, site valuations, site surveys and the processing of lease applications.

Unless the Retail Leases Act 2003 applies, tenants are responsible for these costs.

Legal costs

Tenants are responsible for all legal costs incurred in the preparation of any new lease, or the variation or renewal of an existing lease, unless expressly agreed otherwise.

ARV will recover all associated and recoverable legal costs relating to the drafting and development of the lease documentation.

Tenants are also responsible for obtaining their own independent legal advice in relation to any lease or related legal documentation.

Site valuation

In accordance with the Victorian Government Land Transactions Policy, all leases are subject to a market site rent valuation by:

  • the Valuer-General Victoria, or
  • a registered valuer.

Site rent is assessed based on the site value, as determined by an independent valuation.

Site surveys

Applicants are responsible for all survey costs associated with a proposed lease.

Survey reports from the Surveyor-General may be required where changes to site boundaries are proposed. These reports are used to determine:

  • boundaries and site status
  • encroachments
  • services and utilities
  • survey requirements.

Depending on the information available in the survey report, the Surveyor-General may require a further survey before a lease plan can be produced.

Subject to the survey report identifying any special requirements, applicants may appoint their own surveyor to prepare lease plans in consultation with the Surveyor-General.

Market rent reviews

Standard alpine leases include provisions for:

  • market rent reviews every 3 years, and
  • annual CPI adjustments between reviews.

Processing of additional lease applications and consent requests

ARV must provide written consent when certain transactions occur, including:

  • assignment of a lease
  • creation of a sublease
  • mortgage of a lease, sublease or shares
  • transfer of ownership of a head lease over a Crown allotment
  • transfer of an apartment, unit, car park or shareholding.

A fee of $825 (including GST) is payable to ARV for each consent request.
